RYAN, Circuit Judge. The government appeals the district courts order sentencing defendant Jerry Lee Smith to a prison term of 27 months following his conviction of being a felon in possession of a firearm, in violation of 18 U.S.C. § 922(g)(1). The district court declined to sentence Smith as an armed career criminal under 18 U.S.C. § 924(e)(1), after holding that two of Smiths four prior state felony convictions were constitutionally infirm because Smith had not been properly advised of his constitutional rights under Boykin v. Alabama, 395 U.S. 238, 23 L. Ed. 2d 274, 89 S. Ct. 1709 (1969), before pleading guilty to those two charges.
