This case is before the court on remand from the United States Supreme Court for reconsideration is light of the Government's present position that the prosecution in the instant case is in violation of the Justice Department's ""Petite"" policy. Thompson v. United States, U.S. , 48 U.S.L.W. 3450 (1980). Under the ""Petite"" policy of the Justice Department, United States Attorneys are forebidden to prosecute any person for allegedly criminal behavior if the alleged criminality was an ingredient of a previous state prosecution against that person. An exception to this prosecutorial bar is made only if the federal prosecution is specifically authorized in advance by the Justice Department itself, upon a finding that the prosecution will serve compelling interests of federal law enforcement. See Petite v. United States, 361 U.S. 529, 531 (1960); Abbate v. United States, 359 U.S. 187 (1959).
